1) Who We Are

This website, peaklifestylenv.com (the “Site”), is owned and operated by Jennifer Lee Oropeza, LLC, a Nevada limited liability company (“Company,” “we,” “us,” or “our”).

Brokerage Disclosure. Jennifer Lee Oropeza, LLC is an independent real estate licensee affiliated with Ferrari-Lund Real Estate (“Brokerage”). The Site, its content, and any related marketing or communications are produced solely by Company. Brokerage does not control, endorse, or assume responsibility for the Site or its content.

2) Acceptance of These Terms

By accessing or using the Site, you agree to these Terms of Use (the “Terms”) and to our Privacy Policy and Nevada Privacy Opt-Out page (together, the “Policies”). If you do not agree, do not use the Site. We may update these Terms at any time; changes take effect upon posting. Your continued use constitutes acceptance.

3) Eligibility & Geographic Scope

The Site is intended for individuals 18 years or older located in the United States. If you access the Site from other jurisdictions, you do so at your own risk and are responsible for compliance with local laws.

4) No Agency or Professional Advice; Fair Housing

  • No agency is created by viewing the Site, submitting a form, calling, texting, or emailing. Agency or client representation requires a separate written brokerage agreement executed with the Brokerage and/or Company.

  • Information on the Site is for general informational purposes only and is not legal, tax, financial, or professional advice. You should obtain advice from your own professionals.

5) IDX/MLS Data, Property Information & Availability

Where present, property listings and market data may originate from Northern Nevada Regional Multiple Listing Service (NNRMLS), other MLSs, or third-party providers. All information is deemed reliable but not guaranteed, may change without notice, and may be subject to delays, omissions, or inaccuracies. Properties may be sold, withdrawn, or otherwise become unavailable at any time. Required copyright, attribution, and IDX/MLS notices will appear where listing content is displayed. You may not copy, scrape, or redistribute listing data except as permitted by applicable MLS rules and copyright law.

6) Intellectual Property; Limited License

The Site, including text, graphics, logos, photos, video, and other content (collectively, “Content”), is owned by Company or its licensors and is protected by U.S. and international laws. We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes. Any reproduction, distribution, modification, or derivative use of the Content is prohibited without our prior written consent.

7) User Accounts & Security

If you create an account or save searches, you must provide accurate information, keep your credentials confidential, and promptly update any changes. You are responsible for activities under your account.

8) Acceptable Use

You agree not to: (a) misuse the Site; (b) attempt to gain unauthorized access to systems or data; (c) use bots or scraping tools without our written consent; (d) interfere with network security or performance; (e) use the Site for unlawful, misleading, or harassing purposes; or (f) reverse engineer, frame, or mirror the Site except as allowed by law.

9) Your Submissions; License

If you submit messages, inquiries, reviews, comments, photos, or other materials (“Submissions”), you grant Company a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such Submissions for Site operation, marketing, and service delivery, subject to the Policies. Do not submit confidential or sensitive information through open forms.

10) Communications, TCPA Consent & Opt-Outs

Voluntary Consent. By providing your phone number or email on the Site (e.g., to request information, schedule a showing, or register for alerts), you consent to Company and/or Brokerage contacting you by call, text (SMS/MMS), and email, which may use auto dialers, prerecorded/artificial voices, or automated systems, for transactional and marketing purposes related to real estate services. No purchase is required to receive services. Message/data rates may apply. Message frequency varies.

We do not control or assume responsibility for Third-Party Services and make no warranties regarding their content, policies, or practices. Your use of Third-Party Services is governed by their terms and privacy policies.

12) Mortgage, Affiliated & Referral Disclosures

We may present lender information or connect you with mortgage professionals upon your request (e.g., pre-approval inquiries). No endorsement or guarantee is made regarding any lender or loan product. If we identify an affiliated or compensated relationship, we will provide the appropriate disclosures as required by law.

13) Privacy; Nevada Consumer Rights

Your use of the Site is also governed by our Privacy Policy. Nevada residents may direct us not to “sell” certain personal information (as defined under Nevada law) by submitting the Nevada Privacy Opt-Out form at https://www.peaklifestylenv.com/privacy-opt-out. Additional privacy rights (if applicable) are described in the Privacy Policy.

14) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND QUIET ENJOYMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Real-estate market data, interest rates, school information, taxes, HOA details, and similar information are subject to change and should be independently verified.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL COMPANY, BROKERAGE, OR THEIR OWNERS, OFFICERS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT YOU PAID DIRECTLY TO COMPANY FOR THE SERVICE OR FEATURE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT.

The above limitations do not apply to liability that cannot be limited under applicable law (including liability for fraud, willful misconduct, or gross negligence). These Terms govern website use only and do not limit any duties owed under a separate written brokerage agreement or liability we cannot limit under Nevada law.

16) Indemnification

You agree to defend, indemnify, and hold harmless Company and Brokerage from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your Submissions; or (c) your violation of these Terms or applicable law.

17) Suspension/Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these Terms.

18) Governing Law; Venue; Jury Waiver

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Washoe County, Nevada for any dispute not subject to arbitration (if arbitration is later added by written agreement). You waive any right to a jury trial to the fullest extent permitted by law.

19) DMCA/Copyright Complaints

If you believe material on the Site infringes your copyright, please send a notice that complies with 17 U.S.C. §512(c)(3) to the contact in Section 21. We may remove content and terminate repeat infringers where appropriate.

20) Changes to the Site and Terms

We may modify or discontinue any part of the Site at any time. We may also update these Terms by posting a revised version with a new “Effective date.” Your continued use after updates constitutes acceptance.
